Website Design The information services provided are related to the founder. The websites set up by the government usually provide public information services or e-government services. The websites set up by teaching and research institutions usually provide services such as scientific research information retrieval and scientific research results publishing. The websites set up by enterprises and financial institutions are mostly engaged in commercial activities. However, this classification by subject does not fully represent the nature of website information services. The nature and type of the founder only describe the industry, content and main features of the website services, not other issues. The Measures for the Administration of Internet Information Services (hereinafter referred to as the Measures for Information Services) in China divides network information services into operational and non operational categories according to website service behaviors. The Information Service Measures does not adopt the concept of "public welfare", but "non business", which means that all of them are non business except for business. As for what is "operational information service", the Information Service Measures do not stipulate. According to Article 3 of the Information Service Measures, "operating Internet information services refers to the paid provision of information or web page production and other service activities to Internet users through the Internet. Non operating Internet information services refer to the free provision of open and shared information to Internet users through the Internet.

The author believes that the criterion of operational judgment is to charge service consideration (fee) from users, that is, to engage in paid information services. That is to say, whether to charge users is the standard to judge the business services and non business information services. It is worth noting that "operating" and "profit-making" are two concepts. Profitability and non-profit mainly judge the nature of an organization, and its standard is whether the founder (shareholder or member) gets dividends or investment income (distribution of investment income) from the operation; The operational and non operational nature mainly depends on whether the behavior of the founder belongs to business behavior (or commercial behavior). In this way, a non-profit organization can fully engage in business activities. For example, if a website set up by a public institution allows users to browse or download through charging, this kind of behavior belongs to business behavior, but this kind of business behavior does not change the non-profit nature of its organization.
 
In real life, a website may provide both free information services and charging information services, showing mixed characteristics. Obviously, it is impossible for us to determine the proportion of charging information services that can be positioned as operational information services. Such mixing may not hinder the settlement of information service disputes between website operators and users, because we can judge whether it is paid or unpaid from specific information service behaviors to determine the rights, obligations and responsibilities of both parties. However, for government regulation, this may become a problem. This is because Internet information service managers should clearly define the website as operational or non operational, and then implement different control measures.
